Il Guarantor for the protection of personal data has officially notified a OpenAIthe company behind the artificial intelligence platform ChatGPTfor alleged violations of privacy legislation. This is not the first time the Guarantor has targeted the AI company led by Sam Altman. Last March 30, it had in fact blocked the arrival of ChatGPT in Italy, alleging several alleged violations.

The statement published by the Guarantor claims that the investigation conducted by the Guarantor led to the conclusion that OpenAI may have committed one or more offenses in violation of the EU Regulation on the protection of personal data. The Guarantor explains that it is monitoring OpenAI’s activities and has initiated formal proceedings against OpenAI.
Following notification of the notice of dispute, OpenAI has 30 days to present its defense briefs regarding the alleged violations complained of. This period will allow the company to respond to the allegations and provide any necessary explanations or clarifications.
The Guarantor for the protection of personal data also underlined that, in defining the procedure, it will take into account the work in progress within the special task force established by the European Data Protection Board (EDPB). The task force brings together the European Union’s data protection authorities, and is working to understand how to regulate the management of ChatGPT data.
At the moment, we users we should see no changes in ChatGPT usage: you can continue to use it, whether for free or for a fee. However, the attention of the European Union and that of the Italian Guarantor could lead to new developments. Last year, for example, we saw closer scrutiny of use by minors.
