Il European Council and Parliament have reached a provisional agreement regarding the regulation of the Data Acti.e. the rules on the access and correct use of data in Europe, especially as regards the sectors of the Internet of Things (IoT) and artificial intelligence.
What is the Data Act?
The Data Act proposes new rules on who can access and use data generated in the European Union relating to all economic sectors. Going a little more specifically, the regulation is about ensuring fairness in allocating the value of digital data, contributing to a competitive data market, finding opportunities for data-driven innovation and making data increasingly accessible.
A note from Brussels states that “the new legislation also aims at facilitate switching between providers of data processing servicesputs in place safeguards against illegal data transfers by cloud service providers, and plans to develop interoperability standards for data reuse across industries.
The data law will give to both individuals and businesses greater control over their data through a strengthened portability right, easily copying or transferring data from different services, when the data is generated by intelligent objects, machines and devices. The new legislation will give consumers and businesses the ability to decide what to do with the data generated by their connected products.”
Data Act, how the agreement is configured
The Data Act also explains the scope of application of this legislation. It allows users of connected devices to access data, whether it’s from smart appliances or industrial machinery.
L’Internet of Things (IoT)
The text of the Data Act also expresses itself on theInternet of Things. It contains measures to prevent the abuse of contractual imbalances in data sharing. In addition, the regulation provides further guidance for data provision, such as the protection of trade secrets and intellectual property rights.
