Kathleen McCormickof the Court of Chancery in Delaware, ruled that the trial between Twitter and Elon Musk will begin in October. The rite abbreviated from five days that was what the social media wanted, while Musk was trying to postpone the trial next year.
Twitter vs Musk, trial begins in October (against the wishes of Tesla CEO)
Bill Savitt of the Wachtell, Lipton, Rosen & Katz firm explained to the court that similar trials in the past have seen an accelerated procedure. And that it is essential for Twitter and its shareholders to recover from the “uncertainty of closing the deal e by the alleged insults of Musk“. Furthermore, the lawyer implied that Musk wanted to postpone the trial to allow less time for an appeal and hope that the deal would fade before a sentence.
Musk’s lawyer, Andrew Rossman by Quinn Emanuel, instead argued that the proposed time would not be enough to analyze all the huge data on Twitter bot accounts. But Savitt explained that “nothing in the acquisition agreement raises doubts” about the number of bots. ” The judge seems to have agreed with Twitter: the trial it will be held in October and will last for five days.
Just a few weeks ago, Musk sent a letter to Twitter’s legal department, saying the company’s takeover and privatization deal couldn’t go through. According to Tesla’s boss, Twitter reportedly reported one percentage of spam accounts lower than real. Twitter then sued Musk for “refusing to honor his obligations to Twitter and its shareholders.”
The social network was even looking for a process of four days in September, so the court’s decision is a compromise. But definitely more on the Twitter side.
This first point in the match between Musk and the social network therefore goes to the detriment of the billionaire, who, however, seems willing to keep the point. Although most of this type of dispute is resolved by an agreement between the parties before the sentence, the the last few months of back and forth may have burned the bridges too much.
See you then after the summer to understand how the issue will be resolved. We will keep you posted.
