Activision Blizzard has announced that neither Call Of Duty: Modern Warfare 3 neither Diablo 4 will be coming to Game Pass this year.
No Modern Warfare 3 and Diablo 4 on Game Pass this year
The developer made this known with a post su X/Twitter which reads:
“As we continue to work towards regulatory approval of the agreement with Microsoft, we have received some questions about whether our upcoming and recently launched games will be available on Game Pass. While we have no plans to include Modern Warfare 3 or Diablo 4 in Game Pass this year, once the deal closes, we expect to begin working with Xbox to bring our titles to more players around the world . We plan to start adding games to Game Pass over the next year.”

This maneuver, which will certainly displease Game Pass subscribers, seems to be a choice aimed at approving the acquisition by Microsoft. In fact, as you surely know, Activision Blizzard was formally acquired by Microsoft, but the market authorities around the world have raised doubts about a hypothetical anti-competitive scenario of the agreement. In particular, it is the US FTC (Federal Trade Commission) that raises doubts.
In the meantime, the acquisition has been given the green light in Europe and, provisionally, in the United Kingdom.
